Employer use of TalentConnect – Terms and conditions

1. These Terms and Conditions govern you as an employer or recruitment representative (described in these Terms as You, Your or Employer) in Your access to and use of the TalentConnect platform (TalentConnect).

2. TalentConnect is operated by a third-party provider on behalf of the State of Victoria as represented by the Department of Jobs, Skills, Industry and Regions (described in these Terms as We, Our, the State or the Department).

3. By registering for an employer account (Account) for TalentConnect and posting employment opportunities, You agree to these Terms and to the Privacy Statement available on the website.

4. We may update, modify, terminate, or suspend Your Account or TalentConnect at anytime and for any reason, without providing notice to You.

5. We may update these Terms and Conditions from time to time and We will make these updates available via the TalentConnect platform. If You do not agree with any such amendments to the Terms and Conditions, you must cease using Talent Connect.

6. To open an Account and use TalentConnect, You may be required to provide certain information such as a full name and valid email address (Data).

7. By using Your Account and TalentConnect You irrevocably give the State permission to use Data provided or uploaded to TalentConnect, including but not limited to reproducing, publishing, adapting or communicating the whole or any part of the Data in de-identified format, for any purpose of the State connected with fostering a skilled workforce and innovative local sector that enhances resilience across all industries. Your Data may be shared with research providers and information technology companies in de-identified form.

8. We will handle any Personal Information (as defined by the Privacy and Data Protection Act 2014 (Vic)) we collect about You in connection with Your Account or Your use of Talent Connect in accordance with the Privacy Statement. Your Personal Information may be used to email information about TalentConnect.

Account and use

9. To access and use TalentConnect with an Account, You must be:

  1. a legally entity or an authorised representative of a legal entity,
  2. based in Victoria, Australia, and
  3. be compliant and continue to comply with all applicable laws including (but not limited to) employment, privacy, and anti-discrimination laws.

10. In registering for an Account for TalentConnect, You agree to provide accurate and complete information and maintain the confidentiality of Your login credentials.

11. When using TalentConnect, You will:

  1. use the platform only to promote genuine and lawful employment opportunities,
  2. represent the Employer and the employment opportunity postings truthfully,
  3. treat all candidate data and communications with confidentiality and in accordance with these Terms, and
  4. not engage in any discriminatory, misleading, or exploitative practices in any form.

12. Employers may post employment opportunities using the TalentConnect interface or via bulk upload (if/where enabled). All posts for employment opportunities must:

  1. include clear, accurate, and complete job descriptions,
  2. specify the location, employment type, and key requirements, and
  3. will not include any promotional or non-recruitment-related content.

13. The Department reserves the right to review, edit, or remove employment opportunities post from TalentConnect that it reasonably considers do not comply with the TalentConnect standards or any applicable law.

14. The Employer will not:

  1. misrepresent job roles, compensation, or employment (including any company details)
  2. use TalentConnect to solicit business unrelated to employment,
  3. attempt to extract or copy candidate database contents,
  4. interfere with TalentConnect platform operations or security.

15. By using TalentConnect, You may be introduced to matched candidates based on Your hiring needs and platform algorithms. When engaging candidates:

  1. all outreach must be professional and directly related to legitimate employment opportunities, and
  2. the Employer will not harvest or misuse candidate data outside of the TalentConnect intended scope, and
  3. Your communication must respect a candidate’s privacy and opt-out preferences and You agree to handle candidate data responsibly and in compliance with applicable privacy laws.

16. TalentConnect does not guarantee candidate availability, application volume, or hiring outcomes.

Intellectual property

17. We grant You a limited, non-exclusive, non-transferrable and revocable licence to use Your Account and TalentConnect in accordance with the permitted uses in these Terms.

18. Where We permit, You may upload or share material to Your Account or TalentConnect (for example, testimonials or photos) and by uploading or sharing that material You grant the State an non-exclusive, non-transferrable, royalty free licence to use, copy, modify and reproduce that material for any purpose of the State connected with fostering a skilled workforce and innovative local sector that enhances resilience across all industries and TalentConnect without attribution, payment or compensation to You.

Disclaimer

19. TalentConnect may display, integrate or link to third-party tools, applications or services (e.g. scheduling, video interviews) (Third-party Services) that are not monitored or controlled by the State. By using TalentConnect You acknowledge that any Third-party Services are not provided by the State and the State is not responsible for the accuracy, quality, reliability or completeness of any content of such Third-party Services. The State expressly disclaims any liability to you for any loss or damage incurred by you because of any use by you of, or reliance by you on Third-Party Services. Before using Third-Party Services you should read and understand the terms and conditions and privacy policy provided by the respective provider.

20. Your Account and TalentConnect are provided for the purpose of a platform to enable connections between skilled professionals and employment opportunities and You acknowledge that Your Account and TalentConnect are not offered as or intended in any way to be used as an employment service.

Exclusion and limitation of liability

21. To the fullest extent permitted by law, the State expressly disclaims any liability to You for any liability, loss, damage or expense incurred by You as a result of any use by You of, or reliance by You on, your Account, TalentConnect, or any content or video or other material set out on your Account, TalentConnect or sent to you by the Department.

22. If We are liable for a breach of a guarantee implied by law and that liability cannot be excluded by law but can be limited, our liability is, to the fullest extent permitted by law, limited to supplying the relevant services again.

23. Subject to the liability position described above, Your Account and TalentConnect are provided on an “as is” and “as available” basis. You use Your Account and TalentConnect at your own risk and acknowledge that: (a) you have not relied on any statement, representation, warranty, conduct or undertaking made or given by Us or any person on Our behalf, other than those expressly stated in these Terms and Conditions; and (b) You have relied on Your own skill and judgment in deciding to use Your Account, TalentConnect or to enter into these Terms and Conditions.

24. Subject to the liability position described above, We provide no warranty or guarantee and make no representation that your Account or TalentConnect: (a) will be error-free or available at all or any time; (b) will contain accurate, up to date or complete information; (c) will be compatible with Your hardware, software and other systems; (d) will not contain any viruses or disruptive code; (e) will not infringe any person’s rights (including intellectual property rights); and (f) will be fit for a particular purpose.

27. These Terms and governed by and are construed in accordance with the laws applicable in Victoria, Australia.

28. If any part of these Terms and Conditions is void, voidable, illegal or otherwise enforceable, it may be severed and the remaining provisions of these Terms and Conditions will remain in full force and effect.
